What we scrutinise in contracts to ensure your security

Identification of Parties

Ensure that the names and details of the parties involved are correct and that the seller has the legal right to sell the property.

Property Description

Confirm that the property's description, boundaries, and title details are accurate.

Purchase Price and Payment Terms

Review the agreed-upon price, deposit amount, balance payment terms, and any other financial considerations.

Inclusions and Exclusions

Check the list of fixtures and fittings included in the sale and any items excluded.

Zoning and Land Use

Confirm the property's zoning status and any restrictions or future development plans that might impact its use.

Title Search

Conduct a title search to ensure there are no undisclosed liens, encumbrances, or defects on the title.

Stamp Duty and Taxes

Provide advice on any applicable stamp duty, taxes, or potential concessions available to the buyer.

Settlement Date

Review the proposed settlement date, ensuring it's feasible and aligns with the buyer's requirements.

Default and Breach Provisions

Understand the consequences if either party defaults or breaches the contract terms.

Cooling-off Period

Confirm the duration of the cooling-off period (if applicable) and the conditions under which the buyer can rescind the contract.

Inspection Rights

Ensure the buyer has the right to conduct final inspections before settlement.

Warranties and Representations

Check for any warranties or representations made by the seller regarding the property's condition.

Mortgage Conditions

If the purchase is subject to obtaining a mortgage, review the related conditions and timelines.

Insurance Obligations

Determine which party is responsible for insuring the property up to the settlement date and any subsequent obligations.

Disclosure Requirements

Ensure the seller has disclosed all material facts about the property, including any known defects or issues.

“I am not someone who writes reviews or froths on social media about great service but Ben and Anne have literally driven me to it. Efficient, responsive, strategic advice in our best interest, always willing to jump in, totally in step with us at every step… I will be recommending them to everyone I know who’s looking to buy or sell!!”

We have had such a complex but rewarding real estate journey. This would not have been possible again if not for the amazing expertise that Anne + Benjamin Law has provided us. It was a success during our selling period. The time we purchased our new property to call home was quite complex and we had hurdles that we had to navigate yet we made it through because of Anne and her team's splendid assistance and service. They were always ready to answer our questions and gave us detailed explanations of information from the contract signing down to the day of settlement. We are truly grateful to Anne, Bao, Trish and the rest of her team. I highly recommend them! Thank you so much again! 😊

Anne's and the team have been a great help with my property transfer.

Efficient, clear and timing communication from start to finish, i would highly recommend the team to anyone in need of a property solicitor

Absolutely incredible work from these guys. They were extremely efficient, friendly and personable. This was a very daunting purchase as it was my first however Anne, Trish and Bao were there to answer all of my questions and went above and beyond to ease any anxieties I had. I’ll never use anyone else and recommend these guys.
