Get in touchYou're expected to do your own checks before you sign, since the old "buyer beware" rule still applies. In practice a lot of buyers order their building and pest reports, plus the body corporate records if the property is part of a scheme, during the cooling-off period, because they can take a few days to come back. The right timing depends on the property and how competitive the sale is, so give us a call and we'll point you in the right direction.
It's when a property is listed for auction but the agent lets buyers know the seller will look at offers before auction day. Sellers use it to test how much interest there is and what buyers are prepared to pay. The upside for you is the chance to lock the property away before it goes to the open floor. The downside is you show your hand on price, and the seller can still decide to run the auction anyway. If you're weighing it up, talk to us first.
For most residential contracts in Queensland you get a 5 business day cooling-off period. It starts the day you receive a copy of the signed contract and ends at 5pm on the fifth business day. It doesn't apply if you buy at auction, or if you sign on the day a property is passed in. If you pull out during the cooling-off period, the seller can keep 0.25% of the purchase price. The period can be shortened or waived by agreement, so if an agent asks you to do that, call us before you sign anything.
Queensland transfer duty (stamp duty) is handled by the Queensland Revenue Office. Depending on your situation you might qualify for the home concession, the first home concession, or the first home vacant land concession, and first-home buyers of new builds may also be eligible for the First Home Owner Grant. The QRO website has the full detail, and we can work out what you're entitled to and handle the application as part of your conveyance.
That's set by the contract, but it's usually paid on signing or by a date written into the contract. Ten percent is common, though the amount can be negotiated. One thing worth knowing: if the deposit is more than 10%, the contract can become an instalment contract, which brings extra rules. We'll let you know if that applies. And if an agent pushes for the full deposit before you've signed, check with us first.
The earlier the better. We'd suggest getting in touch once your finance is sorted and before you start seriously inspecting. That way we can talk you through what to watch for and how to approach negotiations, so you're not going in blind.
Yes. In Queensland conveyancing is done by solicitors, so there isn't the separate licensed conveyancer option you'll find in New South Wales or Victoria. The upside is you've got a qualified property solicitor across your file the whole way through, so if anything turns into a dispute, you already have a lawyer who can act for you.
Broadly, you get your finances ready, find a place, negotiate, do your due diligence, sign and exchange contracts, then settle. Once your offer is accepted you'll want a solicitor, and usually a broker, going over the contract, the title and your finance. After you've signed and paid the deposit there's a period leading up to settlement, and we keep you across each step until the property is in your name.
You get the property ready, appoint an agent and take it to market. Once you've agreed on a price, we prepare the contract for the buyer's side to review, then handle the signing and exchange. The buyer pays the deposit, and at settlement the balance is paid and ownership transfers across.
