Get in touchYou're expected to do your own checks before you sign, since the old "buyer beware" rule still applies. In Victoria a lot of the key detail comes through the vendor's Section 32 statement, but many buyers still order building and pest reports, and review the owners corporation records if the property is part of one, before they commit. Some do this in the cooling-off period, since reports can take a few days. The right timing depends on the property and how competitive the sale is, so give us a call and we'll point you in the right direction.
A Section 32, or vendor's statement, is a document the seller must give you before you sign the contract in Victoria. It sets out important information about the property, things like the title, any covenants or easements, rates and outgoings, owners corporation details, and anything else that could affect your decision. It's worth having it reviewed carefully, because it often flags issues that aren't obvious from an inspection. We go through it with you so you know exactly what you're buying.
It's when a property is listed for auction but the agent lets buyers know the seller will look at offers before auction day. Sellers use it to test how much interest there is and what buyers are prepared to pay. The upside for you is the chance to lock the property away before it goes to the open floor. The downside is you show your hand on price, and the seller can still decide to run the auction anyway. If you're weighing it up, talk to us first.
For most residential property in Victoria you get a 3 business day cooling-off period, starting from the day you sign the contract. If you decide to pull out within that time, you'll usually forfeit either 0.2% of the purchase price or $100, whichever is greater. The cooling-off period doesn't apply in some cases, for example if you buy at auction (or within 3 clear business days before or after it), or if you've already received independent legal advice before signing. If you're unsure whether it applies to you, contact us before you sign anything.
Victorian land transfer duty (stamp duty) is handled by the State Revenue Office (SRO). Depending on your situation you might be eligible for concessions such as the first home buyer duty exemption or concession, or the principal place of residence concession, and first-home buyers may also qualify for the First Home Owner Grant. The SRO website has the full detail, and we can work out what you're entitled to and handle it as part of your conveyance.
That's set by the contract, but it's usually paid when you sign or by a date written into the contract. Ten percent is common, though the amount can be negotiated. One thing worth knowing: if the deposit and any instalments come to more than the price minus a set amount, the contract can become a "terms contract," which has extra rules, so we'll let you know if that applies. And if an agent pushes for the full deposit before you've signed, check with us first.
In Victoria you can use either a licensed conveyancer or a property solicitor for your transaction. Both can handle the legal side of buying or selling, but a solicitor brings a broader legal background, which helps if your matter is more complex or a dispute comes up. The earlier the better. We'd suggest getting in touch once your finance is sorted and before you start seriously inspecting. That way we can talk you through what to watch for, review any Section 32 statements, and help with negotiations so you're not going in blind.
Broadly, you get your finances ready, find a place, review the Section 32 and contract, negotiate, sign, then work towards settlement. Once your offer is accepted you'll want a solicitor, and usually a broker, going over the paperwork and your finance. After you've signed and paid the deposit there's a period leading up to settlement, and we keep you across each step until the property is in your name.
You get the property ready, appoint an agent and take it to market. In Victoria you'll also need a Section 32 statement prepared before the property can be offered for sale, which we can take care of. Once you've agreed on a price, we handle the contract, signing and settlement. The buyer pays the deposit, and at settlement the balance is paid and ownership transfers across.
